In the following we inform you about the collection of personal data when using our website. Personal data is all data that can be related to you personally, e.g. name, address, e-mail addresses, user behaviour. When you contact us by e-mail or via a contact form, the data you provide (your e-mail address, name, and telephone number, if applicable) will be stored by us in order to answer your questions. The legal basis for this is Art. 6 para. 1 p. 1 lit. a DSGVO. If the information serves to fulfil a contract to which you are a party or to carry out pre-contractual measures, the additional legal basis for processing the data is Art. 6 (1) lit. b DSGVO.
We delete the data accruing in this context after the storage is no longer necessary or restrict the processing if there are statutory retention obligations.
We would like to point out that data transmission on the Internet (e.g. when communicating by e-mail) can have security gaps. Complete protection of data against access by third parties is not possible.
In some cases, we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions, and are regularly monitored.
2. Collection of personal data when visiting our website
When you use our website for information purposes only, i.e. if you do not register or otherwise transmit information to us, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data:

The data is technically necessary for us to display our website to you and to ensure stability and security. The storage in log files is done to ensure the functionality of the website. In addition, we use the data to optimise the website and to ensure the security of our information technology systems.
These purposes are also our legitimate interest in data processing according to Art. 6 Para. 1 lit. f DSGVO.
The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of the collection of data for the provision of the website, this is the case when the respective session has ended. In the case of storage of data in log files, this is the case after seven days at the latest. Storage beyond this period is possible. In this case, the IP addresses are deleted or alienated so that it is no longer possible to assign the calling client.
The collection and storage of data described above is necessary for the operation of the website. Consequently, there is no possibility for you to object. If you do not agree to this, we recommend that you leave the website.

4. Use of Google Analytics
This website uses Google Analytics, a web analytics service provided by Google, Inc ("Google"). Google Analytics uses the cookies described below, which are text files placed on your computer, to help the website analyse how users use the site.
The _gat cookie is associated with Google Universal Analytics. The cookie is used to throttle the request rate.
This limits the collection of data on websites with high traffic. It expires after 10 minutes.
The _ga cookie is used to distinguish unique users by assigning a randomly generated number as a client ID. It is included in every page request of a website and is used to calculate visitor, session and campaign data for the websites' Analytics reports. By default, it expires after 2 years.
The _gid cookie is related to Google Universal Analytics. It stores and updates a unique value for each page visited.
The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States. If IP anonymisation is activated on this website, however, your IP address will be truncated beforehand by Google within Member States of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.
This website uses Google Analytics with the extension "_anonymizeIp()". This means that IP addresses are processed in abbreviated form, thus excluding the possibility of personal references. If the data collected about you is related to a person, this is immediately excluded, and the personal data is deleted immediately.
We use Google Analytics to analyse and regularly improve the use of our website. The statistics obtained enable us to improve our offer and make it more interesting for you as a user. For the exceptional cases in which personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.

5. Integration of YouTube-Videos
We have integrated YouTube videos into our online offer, which are stored on http://www.YouTube.com and can be played directly from our website. These are all integrated in "extended data protection mode", i.e. no data about you as a user is transmitted to YouTube if you do not play the videos. Only when you play the videos will the data mentioned in paragraph 8.2 be transmitted. We have no influence on this data transmission.
By visiting the website, YouTube receives the information that you have accessed the corresponding sub-page of our website. In addition, the data mentioned in paragraph 3 of this declaration is transmitted. This occurs regardless of whether YouTube provides a user account via which you are logged in or whether no user account exists. If you are logged in to Google, your data will be directly assigned to your account. If you do not want your data to be associated with your YouTube profile, you must log out before activating the button. YouTube stores your data as usage profiles and uses them for the purposes of advertising, market research and/or designing its website in line with requirements. Such an evaluation is carried out (even for users who are not logged in) to provide needs-based advertising and to inform other users of the social network about your activities on our website. 6.1 Google Web Fonts
This site uses so-called web fonts provided by Google Inc ("Google") for the uniform display of fonts. These web fonts are integrated by means of a server call, usually a Google server in the USA. This transmits to the server which of our Internet pages you have visited. The IP address of the browser of the end device of the visitor to these Internet pages is also stored by Google. However, Google states that no cookies are set or visitor data (neither IP address, browser version, nor other personal information) are linked to any other data when the fonts are loaded.
When you call up a page, your browser loads the required web fonts into its browser cache to display texts and fonts correctly. If your browser does not support web fonts, a standard font will be used by your computer.
7. Data protection in applications and in the application procedure
When applying, we collect and process the personal data of applicants provided by you for the purpose of processing the application procedure. The processing may also take place electronically. This is particularly the case if you send us the relevant application documents electronically, for example by e-mail or via a web form on the website.
The legal basis for this use is Art. 6 para. 1 sentence 1 lit. and lit. b DS-GVO.
If an employment contract is concluded with you, we will store the transmitted data for the purpose of processing the employment relationship in compliance with the statutory provisions.
If an employment contract is not concluded, the application documents will be deleted after the expiry of the two-month period for asserting any claims under the General Equal Treatment Act (AGG), provided that no other legitimate interests of the data controller conflict with such deletion. Other legitimate interest in this sense is, for example, a duty to provide evidence in proceedings under the AGG.
This website uses the product Google Maps by Google Inc. By using this website, you consent to the collection, processing, and use of automatically collected data by Google Inc, its representatives and third parties.
9. SSL bzw. TLS encryption
For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
10. Encrypted payment transactions on this website
If, after the conclusion of a contract with costs, there is an obligation to transmit your payment data to us (e.g. account number in the case of direct debit authorisation), this data is required for payment processing.
Payment transactions via the common means of payment (Visa/MasterCard, direct debit) are made exclusively via an encrypted SSL or TLS connection. With encrypted communication, your payment data that you transmit to us cannot be read by third parties.
11. Data transmission when concluding contracts for online shops, dealers, and goods dispatch
We transmit personal data to third parties only if this is necessary in the context of contract processing, for example to the companies entrusted with the delivery of the goods or to the credit institution entrusted with the processing of payments. Further transmission of data does not take place or only if you have expressly consented to the transmission. Your data will not be passed on to third parties without your express consent, for example for advertising purposes.
The basis for data processing is Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfilment of a contract or pre-contractual measures.

13. Subscription to our messenger services
By sending a start message to BEMBEL-WITH-CARE (hereinafter referred to as the sender), I consent in accordance with Art. 6 para. 1 lit. a DSGVO that the sender uses my personal data (e.g. surname and first name, telephone number, messenger ID, profile picture, messages) for direct communication and the data processing required for this purpose using the respective messenger selected. 14.2 Instant bank transfer
On our website we offer, among other things, payment by "Sofortüberweisung". The provider of this payment service is Sofort GmbH, Theresienhöhe 12, 80339 Munich (hereinafter "Sofort GmbH"). With the help of the "Sofortüberweisung" procedure, we receive a payment confirmation from Sofort GmbH in real time and can immediately begin to fulfil our obligations.
If you have chosen the payment method "Sofortüberweisung", you transmit the PIN and a valid TAN to Sofort GmbH, which can then log into your online banking account. After logging in, Sofort GmbH automatically checks your account balance and carries out the transfer to us using the TAN you have transmitted. It then immediately sends us a transaction confirmation. After logging in, it also automatically checks your turnover, the credit line of the overdraft facility and the existence of other accounts and their balances.
In addition to the PIN and the TAN, the payment data you have entered as well as your personal data are transmitted to Sofort GmbH. Your personal data includes your first and last name, address, telephone number(s), email address, IP address and, if applicable, other data required for payment processing. The transmission of this data is necessary to establish your identity beyond doubt and to prevent attempts at fraud.
The transmission of your data to Sofort GmbH is based on Art. 6 para. 1 lit. a DSGVO (consent) and Art. 6 para. 1 lit. b DSGVO (processing for the performance of a contract). You have the option to revoke your consent to data processing at any time. A revocation does not affect the validity of past data processing operations.
15. Photo References
Please note during our presence at various events (e.g. festivals, concerts, motor sports), event photos and videos are taken and published on the basis of legitimate interests such as reporting. Even if you use the Bembel-Riding ride, you may be filmed or photographed in the process. The photo and film material will be used by BEMBEL-WITH-CARE for public relations purposes, e.g. for publication in print media, on the Internet or in social media.
We assume that the persons participating in the event or otherwise involved, through their behaviour of participation or involvement as well as riding the ride, consent to the creation and publication of the recordings for communicative purposes, also in social media. This consent shall apply in particular if the persons involved willingly make themselves available for this purpose, e.g. by "posing" or "looking into the camera". The recordings made will be stored for an unlimited period.
In the case of recordings in which the focus is on individual persons, the participants have the right and the possibility to revoke the publication at any time, even subsequently.
16. Your Rights
You have the following rights, among others, with respect to personal data relating to you:
- Right to information, i.e. you can request detailed information from us about the stored data. Regarding the details, we refer to Art. 15 DS-GVO.
- Right to rectification or deletion, i.e. you can request a correction or completion of personal data or a deletion of the personal data concerning you. In this regard, we additionally refer to Art. 16 or 17 DS-GVO.
- Right to restriction of processing, i.e. restricted processing, e.g. until the accuracy of a claim for rectification can be verified, instead of the right to erasure to which you are entitled, if the data are no longer held by us but are still required by you for certain purposes or if it is not yet clear whether, despite an objection to processing (see subsection 4), processing may nevertheless continue in individual cases, for example because of conflicting interests. For details, please refer to Article 18 of the GDPR.
- Right to data portability, i.e. the right to receive the personal data concerning you in a common format, for example as a computer file. Regarding the details, we refer to Art. 20 DS-GVO.
You also have the right to lodge a complaint about our processing of your personal data with a data protection supervisory authority (e.g. the State Commissioner for Data Protection and Freedom of Information of Baden-Württemberg, "www.baden-wuerttemberg.datenschutz.de").
If you have given your consent to the processing of your data, you may revoke this consent at any time, Art 7 (3) DS-GVO. Such a revocation will affect the permissibility of the processing of your personal data from the time you have expressed it to us.
Insofar as we base the processing of your personal data on the balance of interests, you may object to the processing, Art 21 DS-GVO. This is the case if the processing is not necessary, in particular, for the performance of a contract with you, which is shown by us in each case in the following description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will review the situation and either discontinue or adapt the data processing or show you our compelling legitimate grounds based on which we will continue the processing.
